Data processing and communication

a) The information requested is compulsory and failing your mortgage application being fully completed, this mortgage application may be refused by the Lender, the Data Controller. Any misrepresentation or irregular declaration may be subject to specific processing destined to prevent fraud.

b) When studying your mortgage application, we may use data already known to us and relating to your personal, economical, financial and bank situation and, if need be, that of members of your household. This data and the data you provide in your application will be used in relation to the decision to grant you the loan and for the elaboration of statistical models. Should we refuse the application, you may request an interview with us to present your observations.

c) The Lender may use the data, as well as any subsequent information concerning you, for its operations of management, recovery, credit risk appraisal, its loan granting decision process, its commercial activities, its inquiries and surveys, and to satisfy regulatory measures and obligations, in particular those relating to the fight against money laundering and financing of terrorism, to the transfer of information to the authorised companies of its Group for the purposes of management and financial control and those relating to the "Fichier des Incidents de remboursement des Crédits aux Particuliers" (National Database on Household Credit Repayment Incidents) and the "Fichier Central des Chèques" (Central Cheque Register).

d) Data are subject to processing by a document management system and, as part of the Lender's quality of service procedures, your phone conversations with its personnel may be monitored.

e) The information concerning you will be transferred to companies and sub-contractors that intervene at the request of the Lender, in France, in your country of residence and in the country where the mortgaged property is located.

f) It may also be transferred, under the conditions defined in the French Monetary and Financial Code, as regards the study of the application, the granting of the loan and the prevention of outstanding payments, to subsidiaries of the Lender and to credit institutions subject to banking secrecy requirements that are linked to the Lender for the management of their loans to private individuals.

g) The list of the companies mentioned at paragraph f) is available from the Lender's Service Consommateurs (Customer Service), BP 71015 - 44010 Nantes Cedex 1, and on the website international-buyers.bnpparibas.com.

h) In accordance with Directive 95/46/EC of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, you have a right of access, rectification and objection that may be exercised by writing to the above Service Consommateurs.

i) Save an objection on your behalf, data may be communicated for commercial purposes to providers of services that are provided to you in your capacity of client of the Lender and to the companies of the BNP Paribas Group for the sharing of means or the promotion of the products and services managed by those companies. You can refuse to receive telephone marketing calls by registering on the phone marketing cancellation list at the website www.bloctel.gouv.fr or by post to Society Opposetel, Service Bloctel, 6 rue Nicolas Siret FR-10000 Troyes. Registration prevents professionals from calling you by phone unless there is a pre-existing contract between you.e

International Data Transfer

BNP Paribas Personal Finance is authorized by the French Data Protection Authority ("Commission Nationale de l'Informatique et des Libertés") to transfer personal data related to your personal and financial situation, and if need be, related to the communication means you may use, to operators outside the European Union.

The French Data Protection Authority has authorized the following data transfer to sub-contractors in Morocco:

  • Processing of electronic document management (Decision of 21 June 2007)
  • Processing of phone contacts, e-mail and chat's management related to internet customers (Decisions of 31 January 2008 and 17 July 2008).

The French Data Protection Authority has authorized data transfer to a commercial partner operating in the United States:
